From the Finsbury France loyalty card
Preamble
The France FINSBURY loyalty card is part of the loyalty program developed by FINSBURY AB TRADING SARL, a single-member limited liability company, share capital of 500,000.00 euros, RC Paris B 433 504 230, 14, rue Thérèse 750 01 Paris, E-mail: service.client@finsbury.fr
Article 1. - Characteristics of the card
The FINSBURY loyalty card, in accordance with the general conditions described below, is intended to provide cardholders with exclusive benefits in stores participating in the program and on the website www.finsbury-shoes.com
The FINSBURY loyalty card is free. It is strictly personal and non-transferable.
The FINSBURY loyalty card is not available to employees of FINSBURY and affiliated companies operating a “FINSBURY” branded point of sale, given the special benefits granted to them in this capacity.
Any person holding a loyalty card prior to their hiring at FINSBURY or an affiliated company operating a point of sale under the “FINSBURY” brand is prohibited from using it for the entire period of their employment contract.
The FINSBURY loyalty card is reserved exclusively for FINSBURY customers. The rights and benefits of the FINSBURY card cannot be transferred for payment or exchanged for cash.
It does not constitute a means of payment.
It is neither refundable nor exchangeable for any other product sold in store or on the website.
Article 2. - Acceptance of the general conditions
The cardholder acknowledges having read and accepts these general terms and conditions without reservation or restriction. These general terms and conditions are available on the website www.finsbury-shoes.com and in store.
Article 3 - Allocation of the card
The FINSBURY card is 100% paperless.
Only one card will be allocated per person: same name, first name, address, email.
The card is neither a payment card nor a credit card.
Article 4 - Benefits of the loyalty card
4.1 Card activation
Activation is effective after validation of the mandatory data, including the customer's email address, and provided that the information provided is complete and usable.
4.2 Advantages
The FINSBURY loyalty card allows you to collect points from your first purchase, upon presentation of the card or by identifying the customer at the checkout.
Points can be accumulated on all purchases according to the scale of 1 euro spent giving the right to a credit of 1 point (on the price actually paid at checkout), even on sale or promotional items.
This accumulation does not concern purchases of FINSBURY gift boxes, gift cards and gift vouchers and does not apply to delivery costs from the merchant site.
Points can be accumulated across the entire network of FINSBURY stores in France, Belgium and Luxembourg participating in the program and on the FINSBURY merchant website.
When purchasing on the website http://www.finsbury-shoes.com, points of sale are credited within 15 working days of receipt of the package (return period).
The date of the first purchase triggers the 12-month reference period.
Only whole numbers of points can be credited. If the conversion rate results in a decimal number, the number of points credited will be rounded down to the nearest whole number.
Example: for the purchase of an item at €1.99, the customer will accumulate 1 point.
4.3 Associated Services
The cardholder benefits from the following advantages:
- for 350 points: - 5% on the next purchase
- for 700 points: - 7% on the next purchase
- for 1,000 points: - 10% on the next purchase + a leather treatment and you gain access to the Premium Club
Article 5 - Points credit
To be credited with points for transactions, FINSBURY loyalty program members must be present at the checkout. Compliance with this provision is a condition for the awarding of points. The number of points relating to this transaction will then be credited to their account.
In the event of a complaint, the cardholder may contact FINSBURY customer service by email at the following address: service.client@FINSBURY.fr
Article 6 - Benefit from discount vouchers
Loyalty cardholders earn points on all purchases made in stores located in France, Belgium, or Luxembourg, and on the online store finsbury-shoes.com, and benefit from exclusive advantages. For every euro spent, they earn 1 point. Points entitle them to discounts on future purchases:
- for 350 points: - 5% on the next purchase
- for 700 points: - 7% on the next purchase
- for 1,000 points: - 10% on the next purchase + a leather treatment and you access the Premium Club for a period of 12 months.
- Birthday perk: For your birthday, Finsbury has a surprise perk in store for you, subject to purchase.
The discount voucher can only be used once in Finsbury stores in France or on the website www.finsbury-shoes.com
Loyalty vouchers cannot be combined with each other. A birthday voucher cannot be combined with a loyalty voucher. If you have two vouchers at the same time, the most advantageous voucher will be awarded.
Points acquired during the reference period are automatically reset to zero on the anniversary date of the same period.
It is specified that the reference period is understood as a period of 12 months from the date of the first purchase.
Reaching multiple thresholds in a single sale does not entitle you to accumulate discount vouchers. The voucher issued at the end of the sale is, by default, the voucher with the highest percentage.
Ex: A purchase of 900 euros (900 pts) triggers the crossing of the thresholds of 350 pts (5%) and 700 pts (7%). In this case, your discount voucher will be 7% (and not 5% + 7%).
The benefits cannot be covered in cash under any circumstances.
Article 7 – Cause for termination of validity
7.1 Causes of termination of validity
If the card is not used within 3 years, the customer account will be automatically deactivated from our database. The account will also be deactivated in the event of a violation of the card's general terms and conditions of use, or termination of the program referred to in Article 8.2. Account holders will be notified by any means.
Any deactivation of the account results in the correlative and immediate cancellation of the points accumulated by the holder which have not yet expired, without any compensation being able to be claimed by the holder for any reason whatsoever.
In any case, the points accumulated cannot be transferred to another loyalty card.
The cardholder may cancel their loyalty card upon request to customer service (service.client@finsbury.fr). In this case, the points accumulated will be canceled and the cardholder will not be entitled to any compensation whatsoever.
7.2 Flight
In the event of card theft (hacking of the dematerialized card or identity theft), the cardholder must report it to the store as quickly as possible so that the card can be blocked.
Article 8 - Modification of the general conditions and termination of the program
8.1 Modification of the general conditions
FINSBURY Loyalty Club members agree that these terms and conditions may be amended in whole or in part at any time.
In this case, the holders will be informed by email.
Updated terms and conditions are available at any time at www.finsbury-shoes.com.
8.2 Termination of the Program
Cardholders accept the possibility of temporary and/or permanent termination of the program.
In this case, cardholders will be informed at least one month before the program is actually discontinued. In the event of the program being permanently discontinued, cards will no longer be valid and points credited will be canceled on the date the program is discontinued, without any compensation and/or damages of any kind.
In the event of termination of the loyalty program, the benefits acquired by cardholders may be used for the period indicated to you in store, after which they will be permanently lost. Failure to use the card for a period of more than one year may result in the loss of your membership in the loyalty program and the benefits associated with it.
Article 9 - Collection of personal data and data protection law
9.1 Accuracy and change of the Cardholder's personal data
The cardholder guarantees the accuracy of the data entered on the membership form.
FINSBURY cannot be held responsible for the consequences of communicating erroneous or unusable information.
Any change in the cardholder's contact details specified in the activation form must be communicated to FINSBURY immediately.
The AB Trading Group, owner of the Finsbury brand, guarantees the confidentiality of your personal data. It undertakes to limit its use to internal purposes, and your data will never be disclosed or sold to any third party outside the AB Trading Group.
9.2 Application of Law 78-17 of January 6, 1978 known as Data Protection and Liberties
In accordance with the provisions of Law N78-17 known as Data Protection Act dated 6 January 1978, the holder is informed that the personal information collected by FINSBURY is necessary for processing the activation request and for applying personalized offers linked to the FINSBURY Loyalty Program.
If all mandatory questions on the form are not answered, the FINSBURY Card cannot be activated and no points can be accumulated on the card.
The personal data collected for the FINSBURY card is subject to computerized processing.
Thus, and in accordance with the provisions of the Data Protection Act, the holder has a right to access, rectify and delete data collected concerning him.
This right of access, rectification and deletion of personal data concerning him may be exercised upon written request to FINSBURY customer service.
This right of opposition may be exercised on the customer's account accessible on the website www.finsbury-shoes.com
Article 10 – Jurisdiction
In the event of a dispute relating to the sale or use of the FINSBURY loyalty card, French law alone will apply, and the French courts will have sole jurisdiction.
