Article 1: Scope of application of the General Conditions of Sale

This document (General Conditions of Sale) defines the conditions applicable to sales concluded between, on the one hand, any non-commercial natural person making a purchase on the website www.finsbury-shoes.com , hereinafter referred to as "the customer", and on the other hand, the company AB Trading, hereinafter referred to as "Finsbury" (hereinafter together referred to as the "Parties").

These General Terms and Conditions of Sale exclusively govern the relationship between the Parties and may be amended from time to time. The General Terms and Conditions of Sale, as amended, will be applicable as soon as they are posted online.

These General Conditions of Sale apply to the exclusion of all other conditions, in particular those in force in stores.

Article 2: Order taking

Ordering on the website www.finsbury-shoes.com follows a process based on several complementary steps:

- Selection of products and addition to the basket

- Validation of the contents of the basket

- Choice of delivery method

- Selection of payment method

- Validation of the order summary

- Acceptance of the General Conditions of Sale and sending of the order

- Payment validation

Orders are paid in full and in one go (Payment option in 4x with PayPal or in 3x and 4x with Alma).

The customer receives an order confirmation email from Finsbury. The order invoice is available, downloadable, and printable by the customer in their customer area, as soon as the order is confirmed. Finsbury recommends that the customer retain their order confirmation email.

During these different stages of ordering, the customer can view the details of their order and its total price and correct any errors, before confirming the order when validating payment.

Any order validated by the customer constitutes acceptance by the latter of the prices, product descriptions and these General Conditions of Sale.

Please note that if your payment is declined three times by your bank, the card used will be temporarily unusable on our site for a period of seven days to prevent payment fraud. Your IP address will also be blocked. We therefore invite you to change your IP address and your bank card in order to proceed with the payment.

Finsbury reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to a previous order.

Article 3: Customer area

Placing an order on the site requires the creation of a customer account, which records administrative data concerning the customer as well as delivery data.

The customer account also allows the customer to access the order history as well as a copy of the invoices concerned during the legal retention period.

Article 4: Availability of products

Offers and products offered by Finsbury are available while they are visible on the website, while stocks last.

In the event that a product is unavailable after the customer has placed their order, they will be informed by email. The order will then be automatically cancelled and the customer will be immediately refunded if their bank account has been debited, as provided for in Article 7 of these general terms and conditions.

Article 5: Price

Product prices are listed in euros, including all taxes and excluding shipping costs. The shipping costs are specified on the order form before confirming the order.

Finsbury may change the prices of products sold on the website at any time and without notice. Products will be invoiced based on the prices in effect at the time the order is confirmed.

In the case of an e-reservation, the price applied will be the price at the time of the e-reservation and not the price at the time of the visit to the store.

A €15 surcharge applies to larger sizes. This applies to sizes 12, 12.5, and 13.

The plus size policy is in place to be able to offer customers "extreme" sizes where some of our competitors offer sizes ranging from 6 to 11.5.

At Finsbury we have therefore chosen to offer this larger size chart in order to avoid our customers having to go to the bespoke shoe specialist who charges very high prices (€900 to €2,000).

Production and leather costs are therefore higher, which explains this €15 increase on certain sizes.

When ordering internationally, customs fees are the responsibility of the buyer.

Article 6: Payment terms

Payment for purchases is made at the customer's choice only using the following payment methods:

- by bank card: Visa, MasterCard, AMEX

If paying by credit card, the charge will be made one day after the order date. Finsbury cannot be held responsible for any declined transactions.

The order will be shipped after verification of the customer's bank details and authorization to debit the bank card by the customer's bank. Without such authorization, the sale cannot take place.

When paying with Club Finsbury gift vouchers, the customer, when choosing the payment method, enters the EAN code appearing on the gift voucher in the “advantage code” field.

Article 7: Delivery

Orders placed on the website on Friday afternoon, Saturday, or Sunday will not be processed until the following Monday. Orders placed on the website on a public holiday other than Friday, Saturday, or Sunday will also be processed on the following business day.

The customer is required to check the condition of the delivered products upon receipt of the package.

The customer chooses one of the following delivery methods:

- DPD Pick Up

- DPD Predict

- Click and Collect

- Chronopost

Delivery costs depend on the delivery area, the selected delivery method, and the order volume. The delivery costs corresponding to the customer's delivery choice are displayed on the website during the ordering process, which summarizes the products the customer has selected in their shopping cart.

Delivery is made to the address indicated by the customer in France or internationally ( see list of countries )

The customer can track the progress of the delivery of their order on the DPD or Chronopost website depending on the delivery method chosen.

In the event of a delivery delay of more than 7 days compared to the date agreed upon at the time of ordering, and if this delay is not due to a case of force majeure, the customer may proceed to cancel the sale. This action must be carried out within 60 working days, in accordance with legal provisions.

The resolution must take the form of sending a registered letter with acknowledgment of receipt, addressed to "Internet Customer Service". The letter must be accompanied by the order confirmation email.

If the customer receives the product after cancellation of the order, Finsbury will refund the purchase amount and return costs, upon receipt of the product by Finsbury, complete and in its original condition as provided for in Article 8.

Finsbury dispatches all orders within 48 hours (excluding weekends and public holidays). This dispatch time is in addition to the transport time.

Article 8: Right of withdrawal/Product exchange

In accordance with legal provisions, the customer has the right to withdraw from this contract without having to provide a reason or pay any penalties, except for shipping and return costs. This right does not apply to orders for personalized products. The customer has 14 days (from the day the customer, or a third party other than the carrier and designated by the customer, takes physical possession of the last good) to withdraw from this contract without giving any reason. An order placed on our website cannot be refunded in store.

To exercise the right of withdrawal, you must notify Finsbury of your decision to withdraw from this contract by means of an unambiguous statement by completing the return form in your customer area, within 14 days of receiving the order . In addition to this form, the order must be returned no later than 14 days after sending your withdrawal. The customer will have to bear the direct costs of returning the goods.

To complete the return form, please follow the return procedure below:

1. Go to our website www.finsbury-shoes.com in the “My Account” section.

2. Click on the “My order history and details” tab.

3. Click on your order number (series of letters) in the “payment reference” column; you will find all the details of your order here.

4. Scroll down this page and go to the Return area.

5. Check the product(s) to be returned, indicate whether you want a refund or an exchange, then click on “generate a return”

6. Congratulations, you have generated your return voucher.

7. To print it, go to the “My returns” tab.

8. Make sure to include this label in your return package and send it using the prepaid label included in your package. For an exchange or credit request, return shipping is free. For a refund, return shipping is the customer's responsibility (depending on the carrier option chosen). For any order shipped by DPD International, Chronopost, or DHL, return shipping must be paid by the customer.

9. Once your return has been processed by our logistics team, we will notify you by email.

You must return the goods to the address indicated on the return slip within 14 days of receiving your package. This deadline is deemed to have been met if you return the goods before the expiry of the fourteen-day period.

If you withdraw from this contract, we will refund the amount of the returned products less the shipping and return costs, in any case no later than fifteen working days from the day we received the returned package. We will make the refund using the same means of payment as that used for the initial transaction, unless you expressly wish to use a different means (means proposed by Finsbury at the time of payment); in any case, this refund will not incur any costs for you.

Returned items must be new, unused, in their original packaging, and in perfect condition. Any product showing signs of wear, damaged, not accompanied by the return slip, or addressed to an address other than the one indicated will be refused by Finsbury. In this case, the products will be returned to the customer at their expense, without the customer being able to request a refund or exchange.

Responsibility for the package remains with the sender. FINSBURY declines all liability for loss or theft of goods in this case. We therefore recommend that returns be made by tracked DPD against signed proof of delivery.

In the event of an exchange, we will send the desired product as soon as your return package has been received and inspected by our logistics department. You will be informed by email of the progress of the procedure.

Please note that in the event of high activity (sales, Black Friday, 1001 pairs operation, Private Sales, etc.) the return processing by our team may be extended to between 7 and 14 days upon receipt of the return package.

Article 9: Reservation of ownership

Finsbury retains full ownership of the products purchased by the customer until the latter has fulfilled all of its obligations and in particular until full payment of the price.

Article 10: Reimbursement and credit note

Refunds for products will be issued within 15 business days of receipt of the returned package. In some cases, this period may be extended; the customer must check the returned goods and this will trigger the refund.

Refunds include the price of the products less shipping and return costs.

Reimbursement will be made using the same means of payment used by the customer for the initial transaction, unless expressly agreed by the customer and Finsbury for another means proposed at the time of payment.

In the absence of a refund, a credit note may be issued. The credit note is valid for a maximum period of 12 months from the date of issue. It is only valid for online purchases and cannot be accepted in stores.

Article 11: Analysis of transactions and fight against fraud

Information related to the customer's order is subject to automated data processing, for which ElysNet and Adyen are responsible. The purpose of this automated data processing is to define a level of analysis for a transaction and to combat credit card fraud.

ElysNet, Adyen, and Finsbury are the recipients of data related to the customer's order. Failure to provide data related to your order prevents the customer's transaction from being completed and analyzed.

The occurrence of an unpaid amount due to fraudulent use of a bank card will result in the registration of the contact details relating to the customer's order associated with this unpaid amount in a payment incident file implemented by ElysNet. An irregular declaration or an anomaly may also be subject to specific processing.

In accordance with the French Data Protection Act of 6 January 1978, the customer has the right to access, rectify and object to all of their personal data at any time by writing to the following email address: service.client@finsbury-shoes.com.

Article 12: Conservation of order elements – Proof

Finsbury ensures the conservation of purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of the law of March 13, 2000 and Article 1348 of the Civil Code. Finsbury ensures the conservation of this document for ten years and guarantees its access to the customer if the latter requests it.

Unless proven otherwise, the data recorded by Finsbury and the validation of the order by the customer constitute proof of the entirety of the said order in accordance with the provisions of the law of March 13, 2000 and will constitute the due date for the sums committed by the entry of the products appearing on the order form. This validation constitutes signature and express acceptance.

Article 13: Liability

Finsbury cannot be held liable for non-performance of the contract concluded, due to the occurrence of a force majeure event, the occurrence of an event attributable to the customer or any inconvenience, unforeseeable and insurmountable damage inherent in the use of the Internet network, in particular a breakdown in service, an external intrusion or the presence of computer viruses.

The photographs and descriptive illustrations of the products displayed on the website have no contractual value and therefore cannot engage the responsibility of Finsbury.

Article 14: Guarantee

The products offered by Finsbury are subject to the legal guarantee provided for by articles 1641 et seq. of the Civil Code.

Any potentially defective product will be assessed by Finsbury's after-sales service, and the customer must provide proof of purchase to prove the date of purchase of the product. Products deemed "defective" may be exchanged or refunded in accordance with the conditions of Article 7.

Finsbury uses its best efforts to deliver to the customer items that comply with the provisions of provisions L211-4 and L211-5 of the French Consumer Code. However, Finsbury cannot prevent any possible non-compliant delivery.

In the event that an anomaly (item missing from the order form, damaged or opened package, damaged item, etc.) concerning the product is noted by the customer at the time of delivery, the customer has a period of 3 days from delivery to make any reservations or complaints respecting the formalities of the return procedure described in article 8 hereof. When the customer makes his request to Customer Service, he explains the reasons for his request and the anomaly in question.

After this period and if this formality has not been complied with, the items will be deemed to be compliant and free from any apparent defect and no claim may be validly accepted by Finsbury.

If the apparent defect or lack of conformity of the item is proven, Finsbury undertakes to replace the item or reimburse the customer as soon as possible and at its expense, as provided for in article 7 hereof.

In the event of abnormal or abusive returns from a customer, Finsbury reserves the right to refuse a subsequent order placed by the same customer.

The provisions of this article do not prevent the customer from benefiting from the right of withdrawal provided for in article 6.

Article 15: Protection of personal data

The information and personal data collected and processed within the framework of the relationship with the client are intended to enable the management of this relationship.

They may be transmitted to companies contractually linked to Finsbury for the execution and management of orders and their payment.

In accordance with the provisions of Law No. 78-17 of January 6, 1978 relating to information technology, files and freedoms, the customer has a right to access and rectify data concerning him/her, as well as a right to object to the processing of his/her data for a legitimate reason.

Finsbury may use cookies to recognize the customer when they log in to the website. The sole purpose of these cookies is to enable and facilitate online shopping. These are small text files stored on the hard drive. Most cookies are intended to enable or facilitate customer navigation and are necessary for the Finsbury online store to function. The use of cookies, whether our own or third-party, that are not necessary for the website to function requires the express consent of the user. The customer may disable the use of these cookies at any time by selecting the appropriate settings in their browser. However, this deactivation will prevent access to certain features of the website.

The recipients of your personal data are, where applicable, our payment or payment security providers, our delivery service providers, and our business partners. Article 17: Applicable law and jurisdiction

These General Terms and Conditions of Sale are subject to French law. The language of this contract is French.

In the event of a dispute, the French courts will have sole jurisdiction.

The website complies with French law, and under no circumstances does Finsbury give any guarantee of compliance with local legislation that would be applicable to the customer, since the customer has accessed the website from a country other than France.

Alma: Pay in installments with Alma

  • We offer our Customers Alma's credit service for the settlement of their purchases and payment execution. This is subject to the Customer's acceptance of the Terms and Conditions or the credit agreement offered by Alma.
  • Any refusal by Alma to grant credit for an order may result in its cancellation.
  • Any termination of the General Terms and Conditions which bind the Customer and the Seller shall result in the termination of the General Terms and Conditions or the credit agreement between Alma and the Customer.
  • Payment in three or four installments is available through our partner Alma. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure.

    Amount of purchases :
    Only purchases between €60 and €2,000 are eligible for payment with Alma.

    Costs :
    • For payment in 3 installments: 1.23% excluding VAT
    • For payment in 4 installments: 1.86% excluding VAT
  • Alma is a telepayment manager and issues an electronic certificate which will serve as proof of the amount and date of the transaction in accordance with the provisions of Articles 1316 et seq. of the Civil Code.

  • Termination :
    Any termination of the General Terms and Conditions which bind the Seller and the customer, results in the termination of the General Terms and Conditions between Alma and the customer.

    The amount is paid by a credit granted by Alma SAS registered on REGAFI under number 90876.
  • Payment : Payment by credit is available for the settlement of their purchases via our partner Alma, the execution of the payment is conditioned by the signature of the credit agreement proposed by Alma. The Seller accepts in advance the granting of credit concluded between Alma and the customer in accordance with Article L312-46 of the Consumer Code. If Alma agrees to grant credit to the customer, the amount will be paid by credit in accordance with Article L312-45 of the Consumer Code. Any refusal by Alma to grant credit for an order may result in the cancellation of the order, unless the customer agrees to pay cash.   • Security : Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure. Alma manages remote payments and issues an electronic certificate that will serve as proof of the amount and date of the transaction in accordance with the provisions of Articles 1316 et seq. of the French Civil Code.

  • Special case : In the event of a sales contract or provision of services with successive execution or delivered over relatively long periods, the Seller must specify in its General Terms and Conditions the start time of delivery or supply.
